Rents can now only be increased once a year

As of 1 May 2026, major reforms brought in by the Renters’ Right Act will be enforced. The new Act predominantly affects residential tenancies however some commercial property will be affected, particularly the landlords rather than the tenants.

One of the key measures that have been introduced relates to rent and rental increases. Prior to 1 May 2026, it was possible for landlords to agree rent increases with a tenant as per any standard rent review clauses within these types of agreements. There were no restrictions as to how often rental increases may occur. 

 

How often are landlords allowed to increase rent?

As of today, the Act will only permit rent to be increased once per year. 

In relation to ongoing leases that include rent review clauses, these will be rendered void by the Act, along with automatic rent increases and all rent review clauses will be abolished. 

 

How much notice do landlords need to give tenants?

Another change that will be implemented by the Act is the notice period. 

Landlords will now be required to give a minimum of 2 months' notice for the annual increase of rent, in comparison to the previous 1 months' notice, applicable if the rent was paid on a monthly basis.

 

Can tenants dispute rental increases?

There is still an option for tenants to dispute the level of increase in their rent rent, if they believe that it is over the market rate. This would need to be raised with the Tribunal prior to the start date of the proposed new rent and it is advisable to seek urgent legal advice if your landlord is proposing to impose an above-market rental increase, which you wish to challenge.
