Solar Farm Planning Permission Quashed

Sussex District Council recently granted consent for the installation of solar panels covering an area of 44 acres, together with a solar energy generating station.

An application for judicial review alleged that the Planning Authority had failed to assess the effect of the development upon historic buildings and their setting, in accordance with the national planning policy framework.

The Court agreed that the judicial review grounds were “plainly arguable” and as a result the original planning decision was quashed. The Council agreed to pay the Claimant’s costs.

This decision could have a substantial impact on developers submitting solar farm applications and those who wish to object to them.
