Are No Win No Fee Claims Still Possible?

Judith Thompson

If you have a strong claim for damages, with a good chance of success, Samuels will endeavour to support you by entering into a conditional ("no win no fee") agreement with you.

We have always tried to assist our clients by finding creative ways to pay for litigation, wherever possible, and we continue to do so.

Now that legal aid has all but disappeared, we strongly believe that where you have a strong claim, you should have access to justice. We demonstrate this by sharing the risk of your litigation with you under a "no win no fee" (conditional fee) agreement.

How does a "no win no fee" agreement work? It is really very straightforward:

  • if you lose your claim, you do not have to pay any fees to us (although there might be out of pocket expenses such as court fees that you would need to cover); and
  • if you win your claim, you pay our fees, plus a "success fee". In the vast majority of cases, we would expect to recover most of our fees from your opponent, although you would pay our success fee.

If you have a strong claim, don't delay - you only have a limited time to take action. If you are worried about how you are going to pay, contact us today, to discuss how we can help.
